1.1 The owner of Moteefe.com (the “Platform”), Custom Materials Ltd (“We” or “Us”), are committed to our users’ privacy.
1.2 This policy (together with the Moteefe Terms and Conditions and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us during your use of the Platform, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will treat it. By visiting the Platform you are accepting and consenting to the practices described in this policy. Capitalised terms used in this policy will have the meaning given in the Moteefe Terms and Conditions, unless defined otherwise.
1.3 We collect, store, use and protect your personal information in a transparent way in accordance with the Data Protection Act 1998. For the purpose of the Data Protection Act 1988 (the “Act”), the data controller is Custom Materials Ltd of 36 Limburg Road, London, SW11 1HB, United Kingdom.

2. Collection and use of information
2.1 We may collect the following data about you:
2.1.1 information about you that you give us when you use the Platform including by filling in forms on the Platform or by corresponding with us by phone, e-mail or by using any messaging or weblog functionality provided through the Platform, or otherwise. It includes your username and contact details including your address, e-mail address and phone number that you provide to us. Our payment services provider may collect, process and store your payment details. The privacy policies of our payment services provider(s) (please see here, here, here and here) applies in relation to the collection and processing of such data. We will not receive your payment details if you are a Purchaser but we will receive and store payment details of Designers in order to process payments as required;
2.1.2 information collected by us automatically about your visit to the Platform including but not limited to: technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; the full Uniform Resource Locators (URL), clickstream to, through and from the Platform (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, any phone number used to call us.
2.1.3 details of transactions you carry out through the Platform, in particular orders placed between a Purchaser and a Designer for the purchase of Products.
2.2 The data you give to us may be used:
2.2.1 to meet any request you make on the Platform and deliver the services you request;
2.2.2 for the purposes of carrying out our obligations and to enable users to carry out any obligations under contractual agreements entered into using the Platform. For the avoidance of doubt, this includes the use of data for the purposes of performing Contracts entered into between a Purchaser and a Designer. You acknowledge that data collected by us or provided by you as a Purchaser may be disclosed to the relevant Designer for use in accordance with this policy;
2.2.3 to contact you where it is necessary concerning the services you request;
2.2.4 to keep you informed of the Platform services and news and to notify you about changes to our services; and
2.2.5 to provide you, or permit Designers or selected third parties to provide you, with information about goods or services that may interest you. If you have previously made purchases from Designers using the Platform, we or the Designer in question will only contact you by electronic means (e-mail or SMS) with information about other products similar to those which you showed interest in or purchased. If you are new to the Platform, or where we permit selected third parties to use your data, we (or they) will contact you by electronic means only if you have consented to this. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data (the order form).
2.3 The data collected by us may be used:
2.3.1 to administer the Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
2.3.2 to improve the Platform to ensure that content is presented in the most effective manner for you and for your computer;
2.3.3 to allow you to participate in interactive features of our service, when you choose to do so;
2.3.4 as part of our efforts to keep the Platform safe and secure;
2.3.5 to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you;
2.3.6 to make suggestions and recommendations to you and other users of the Platform about goods or services that may interest you or them.
3. Information Disclosure
3.1 We may share your data (including personal data) with:
3.1.1 any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006;
3.1.2 Designers, our staff, business partners, suppliers and contractors only to the extent and for the purpose for which it was supplied (for the avoidance of doubt this may include, but is not limited to, the performance of Contract between a Designer and you as a Purchaser);
3.1.3 Designers to allow them to contact you about current, previous or future Campaigns;
3.1.4 advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in a given geographical area). We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience;
3.1.5 analytics and search engine providers that assist us in the improvement and optimisation of the Platform; and
3.1.6 credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you.
3.2 We may disclose your personal information to third parties:
3.2.1 in the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
3.2.2 if Custom Materials Ltd or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;
3.2.3 if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms and Conditions and other agreements; or to protect the rights, property, or safety of Custom Materials Ltd, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction;
3.2.4 in accordance with our Copyright and Trade Mark Policy, including in relation to an allegation of infringement of intellectual property rights by a Campaign set up by you.
4. Data Safekeeping
4.1 The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, development of functionality for the Platform, assisting in the fulfilment of orders placed by Purchasers with Designers, the processing of payment details and the provision of other support services.
4.3 Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Platform, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
4.4 We will be using a SSL connection on the Platform when we collect your requests and billing information. But please remember, even if we use sophisticated encryption we cannot guarantee the security of the transmission of information over the internet. You should realise that such transmission is conducted at your own risk. However information will be kept on secure servers and key information encrypted if transmitted by us.
5. Other Platform links
6.1 Cookies are text files stored, either on a temporary or persistent basis on the hard drive of your computer. Cookies are used for authenticating, session tracking and maintaining specific information about the use and users of the Platform.
6.2 The data collected by cookies is anonymous. You can delete all cookies that are already on your computer's hard drive by searching for files with "cookie" in it and deleting them. In addition, if you want to stop cookies from being stored on your computer, you can edit your browser settings so that cookies are blocked. 6.3 Web beacons consist of a small string of software code that represents a graphic image request on a page or email. There may or may not be a visible graphic image associated with the web beacon and often the image is designed to blend into the background of a page or email. Web beacons can be used for many purposes - including site traffic reporting, unique visitor counts, advertising auditing and reporting, and personalization. Web beacons used by the Platform collect only anonymous data.
(a) to remember your login or to keep session information;
(b) to make the Platform work more effectively; and
(c) anonymous cookies are used to analyse how many visitors come to the Platform and to track how they use it.
6.6 On the Platform, we are using information about your visit to serve you relevant advertisements on other websites, including Google, across the Internet. This is achieved by placing a cookie on your browser which is then called upon by a third-party website which then serves you our ad. Never in this process is person data (i.e. data allowing you to be personally identified) passed between us and the website serving the ad.
7. Access and update
7.1 Users of the Platform have the right to:
(a) ask us for a copy of the information supplied by you that we hold by making request to firstname.lastname@example.org. We are entitled to charge you a standard fee of £10 for this service; and
(b) ask us to stop using your personal data or contacting you in the future, for marketing purposes.
8.1 We will give you the option to opt out of our marketing communications or emails. If you would like to change these preferences then you should use the unsubscribe link at the bottom of our emails or contact us.
8.2 Where we have disclosed your personal information to Designers pursuant to paragraph 2.2, those Designers are authorised by you to send targeted marketing communications to you by electronic means. In the event that you do not wish to continue to receive further emails from a Designer, you may opt out of their marketing communications and emails by clicking the unsubscribe link in any email from them.

10.1 We intend to meet the highest standards when collecting and using your personal information. In any case you suspect that our collection or use of information is unfair, misleading or inappropriate we encourage you to bring it to our attention.
